Public Transport Corporation (SPTC, “we”, “our” or “us”) is committed to
keeping your information private. We consider “your information” to be any
information that about you that either you share yourself or third parties
share about you.
This Privacy Policy refers in the case
of information that is shared to the
SPTC App.
Please
note: You are not obligated by law to provide
us with any information. You hereby acknowledge,
warrant and agree that any information you do provide us is provided of your
own free will and consent,
for the purposes and uses described herein.
YOU MAY ACCESS AND/OR USE THE SERVICE
ONLY IF YOU FULLY AGREE TO THIS PRIVACY POLICY – AND BY ACCEPTING THIS PRIVACY
POLICY, ACCESSING AND/OR USING THE SERVICE, YOU SIGNIFY AND AFFIRM YOUR
INFORMED CONSENT TO THE COLLECTION
AND PROCESSING OF YOUR PERSONAL INFORMATION AS DEFINED AND EXPLAINED BELOW. IF
YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT USE THE SERVICE.
Types of
information collected:
We may collect two types of data and information
from our Users.
The first type
of information is nonidentifiable and
anonymous information (“Non-Personal Information”). We are not aware of the
identity of the User from which we have collected only the Non-Personal
Information.
Non-Personal
Information which is being gathered consists of technical information and behavioural data
regarding the activity of the User on the Service, operation system and
browser, type of mobile device, and operating system version and settings,
User’s screen resolution, duration of usage of the Service, User’s
‘clickstream’ on the Site, keyboard language, etc.
The second type of information is individually
identifiable information (“Personal Information”). This information may, in itself or taken together with additional information
available to SPTC, identify an individual,
or may be of a private and/or sensitive nature.
Personal Information we collect includes:
1. username,

address,
3. phone
number,
4. your
geo-location,
5. your
travel habits (such as routes, times of travel from one destination to
another),
6. your
home address,
7. office
address or other favorite destinations,
8. public
transportation lines,
9. stations
and/or routes you may have saved or searched for,
10. User’s
search history on the Service,
11. User’s
most-used routes and stations,
12. all
User-generated data,
13. User’s
reports and reviews regarding the Service,
14. your
in-app settings,
15. your rank
and user profile
16. User
IP address,
17. and
any additional information which the User actively chooses to provide.
The geo-location information we collect includes
detailed location and route information, including
GPS signals and other information sent by your mobile device for which the
Service is installed and
currently activated. SPTC uses this location and route information to create a
detailed location history
all of public transit trips.
We collect such information via your use of the Service and through information
which you voluntarily
provide and/or upload to the Service as further described in this Privacy
Policy below, for purposes of
providing the Service, enhancing the User's experience and personalizing the
Service and security
purposes as further detailed below.
Collection
of user information:
There are two main methods we use:
(1) Use of the Service: We collect
Non-Personal and Personal Information when you access or use the
Service. In other words, we are aware of your usage of the Service and may
gather, collect and record
the information relating to such usage. We also collect Non-Personal and
Personal Information derived
from information we receive from third party services and providers we work
with.
(2) Voluntarily Provided: We may
collect Personal Information which you voluntarily provide when you
use the Service.
Usage
of information:
Your information is collected for the following purposes:
(i)
to provide you with and
to operate the Service, including for statistical and research purposes and
creation of aggregated anonymous data;
(ii)
to personalize the
Service and content provided to you, to customize your experience with the
Services,
(iii)
to suggest you with
transport recommendations based on your preferences and to enable you to
retrieve your information;
(iv)
to develop, improve and
customize the Service, the experience of other users and
the offering available through the Service;
(v)
to be able to contact
Users for the purpose of providing them with technical assistance, support,
handle requests and complaints and collect feedback in connection with
performance of the Services;
(vi)
to send you updates,
notices, announcements, and additional information related to the Service
(vii)
to be able to reply to
User online queries in connection with performance of the Services;
(viii)
for customization and
improvement of the Service’s accuracy and interface;
(ix)
to use such information
for SPTC commercial purposes;
(x)
to display or send to
you marketing and advertising material when you are using the Service,
including in accordance with the section titled 'Direct Marketing' herein and
(xi)
to comply with any
governmental agencies' legal requests or court orders, and/or with any
applicable law, rule or regulation. Any statistical, aggregated or anonymous
data may be used by us at our discretion for any purpose.
Sharing
of information with third parties:
SPTC will not share any Personal Information it
collects with any third party, except in the following cases:
(i)
to satisfy any applicable law,
regulation, legal process, subpoena or governmental request;
(ii)
to enforce this Privacy Policy and/or
the Terms of Use, including investigation of potential violations thereof;
(iii)
to communicate with its Users regarding
our service;
(iv)
to detect, prevent, or otherwise address
fraud, security or technical issues;
(v)
to respond to User's support requests;
(vi)
to respond to claims that any content
available on SPTC’s Service violates the rights of third parties;
(vii)
to respond to claims that contact
information (e.g. name, e-mail address, etc.) of a third-party has been posted
or transmitted without their consent or as a form of harassment;
(viii)
to protect the rights, property, or
personal safety of SPTC, its Users, or the general public;
(ix)
when SPTC is undergoing any change in
control, including by means of merger, acquisition or purchase of all or
substantially all of its assets; or
(x)
to collect, hold and/or manage your
Personal Information through SPTC’s authorized third party
service providers, as reasonable for business purposes, which may be located in
a country other than the country of your residency or location, that may not
have the same data protection laws as your jurisdiction, as listed below;
(xi)
pursuant to your explicit approval prior
to the disclosure;
(xii)
cooperate with third parties for the
purposes of adding operational features to the Service, enhancing and
personalizing the User's experience, monetization and commercialization; or
(xiii)
to authorized third party service providers
solely for the purpose of providing you with the Service.
For avoidance of doubt, SPTC may
transfer and disclose or otherwise use Non-Personal Information or information
which is linked to anonymous random identifiers or information that is
aggregated in a nonidentifiable way, at its own discretion.
Deletion
or Modification of Personal Information:
SPTC retains Personal Information for such a period of time
as is necessary in order for SPTC to be able to use the Personal Information
for the sole purposes described in this Privacy Policy and for the purpose of
providing its Services under the Terms of Use.

for any reason you wish to modify or delete your Personal Information

or by following the deletion process via your application: Home button “My
profile”, “Delete my account”.
We
will make reasonable efforts to modify, anonymize or delete any such Personal
Information pursuant to any applicable privacy laws.
Disclaimer
– Third party Software:
While using the Service we may be using third party software and/or service for
various needs, inter
alia, in order to collect and/or process the
information detailed herein (the “Third Party Service
Provider”). Note that these are independent software and/or service providers
and SPTC does not take
any liability about the information collection policies of these providers, or
about any kind of issue,
legal or otherwise, relating thereto.

Direct.Marketing:
You hereby agree that we may use your contact details for the purpose of
informing you regarding our products and Service, which may interest you, and
to send to you other marketing material, transmitted to the email address or to
the mobile device.

We
may also permit, solicit or contract certain authorized partners of SPTC to
conduct advertising campaigns on the Services. In addition, SPTC may display
advertisements via the Service. Such advertisements that you see when accessing
the Service may be targeted on the basis of your
geographic location and language. It is clarified that SPTC is not responsible
for the content of said advertisements and the products delivered or services
rendered thereby by third parties and you irrevocably
and unconditionally agree that we shall not be held responsible or liable in
connection thereof.
Security:
We take a great care in implementing and maintaining the security of SPTC's
Service and its User's Personal Information.
SPTC
employs industry standard procedures and policies to ensure the safety of its
Users’ Personal Information, and prevent unauthorized
use of any such information.
We
cannot, however, guarantee that unauthorized access will never occur.
Client Information Storage Area
The Information that we collect from you is stored in the European Economic
Area ("EEA") but for the purposes of providing support and handling
the Services may be accessed transferred to, and stored at, a destination
outside of your country and the EEA. By submitting or permitting us to collect
your Information, you agree to this transfer, storing or processing outside of
the EEA.
Information transferred will be treated in accordance with this Privacy Policy.
Changes
to the SPTC Privacy Policy
The terms of this Privacy Policy will govern the use of the Service and any
information collected therein.
SPTC
reserves the right to change this policy at any time, so please re-visit this
page frequently. In the event of any substantial change of this policy, we will
make reasonable efforts to post a clear notice on the Site. Such substantial
changes will take effect seven (7) days after such notice was provided on our
Services or sent by email. Otherwise, all other changes to this Privacy Policy
are effective as of the stated “Last Updated” date and your continued use of
the Service after the Last Updated date will constitute acceptance of, and
agreement to be bound by, those changes.

do not provide SPTC with information which violates any third
party intellectual rights. Without degrading from the aforesaid, all
rights, including intellectual property, arising from your communication with
us will be owned by SPTC and will be considered as SPTC’s confidential
material. It is clarified that any use of the information you are providing us
will be done in SPTC’s sole discretion, and SPTC is not obligated to use all or
part of such information.

THESE
TERMS OF USE (OR “TERMS” FOR SHORT) ARE A LEGAL CONTRACT BETWEEN YOU AND
THE SEYCHELLES PUBLIC TRANSPORT CORPORATION (“SPTC”,“US” OR “WE”). THEY
GOVERN YOUR INSTALLATION AND USE OF THE SPTC MOBILE APPLICATION (THE “APP”),
AS WELL AS YOUR ACCESS TO AND USE OF ALL SERVICES PROVIDED THROUGH OR ENABLED
BY THE APP (THE “SERVICES”).
PLEASE
READ CAREFULLY, SINCE THIS DOCUMENT INCLUDES LIMITATIONS OF LIABILITY AS WELL
AS DISCLAIMERS OF WARRANTIES, AND OTHER TERMS WHICH AFFECT YOUR LEGAL RIGHTS.
IF YOU DO NOT AGREE WITH THESE TERMS, OR IF YOU LACK CAPACITY OR AUTHORITY TO
AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE APP OR ACCESS THE SERVICES.
1.
Changes to these Terms
We
may amend any part of these Terms by adding, deleting, or varying their
content. These amendments may be made at any time and from time-to-time in our
discretion.
We
will provide you with notice of the proposed amendment by posting an amended
version of these Terms with a new version number. We will include a link to the
previous version of the terms beneath the new version number. The amendments
will take effect 30 days after the date on which the amended version is posted.
Prior to that date, the previous version of the Terms will continue to apply.
If
you disagree with any amendments, you may terminate these Terms by uninstalling
the App and ceasing to use the Services at any time within the 30-day notice
period. If the amendment increases your obligations under these Terms, or
decreases our obligations under these Terms, then you can also cancel in the 30
days after the amendments take effect. There will be no cost or penalty for
doing so. If you do not uninstall the App and cease using the Services during
that time, then by your continued use, you are considered to have accepted the
proposed amendments.
2.
Scope of Services
To
get the most out of the App, it is important to understand our role in
providing the Services. The App and Services contain material that we produce
and own in order to make mobility services along our
routes easy to use. This material includes, but is not limited to software,
text, graphics and images ("SPTC Content"). We are an information
organizer and aggregator. This information includes the locations of public
buses, and the map itself. We provide predictions regarding arrival and
departure times, we may develop additional information based on the above
referenced location or availability of services, for example by modifying
expected arrival times. Such times are only estimates. The actual timings are
based on a number of factors including traffic,
boarding, detours and the like, which are beyond our control. We work to ensure
that the information is correct and up-to-date.
However, we cannot reasonably verify all of this
information, let alone in real-time. If the information provided to us is inaccurate
or incomplete, your ability to effectively use the App or Services may be
compromised through no fault of SPTC, and in those cases any legal
responsibility for any problems or damages which might occur lies with the t
information provider rather than (and to the exclusion of) SPTC itself.
If
you are able to purchase third party goods and
services through the App, we are acting as a broker to refer you to the seller
of those goods or provider of those services. In some cases
we may process payments or aggregate services or usage of those services to
provide you with additional benefits. We do not act as agent for either you or
that third party, and instead you contract directly with the third party. Your
purchase of the goods or services will be subject to separate contracts and
terms of use in addition to these Terms. Any disputes or legal claims for
problems or damages arising from or related to these third-party contracts,
goods, or services, or any third-party websites or apps which are used in the
process must be addressed exclusively to those third parties.
However,
such disputes or claims shall be addressed to SPTC where Transit shall act as
the merchant of record. For such purchases, all sales are final, and any
customer service requests, disputes and chargebacks shall be addressed to and
handled by SPTC.
In order to
access certain services, you may be required to create a SPTC account. If you
do so, you are responsible for maintaining the confidentiality of your SPTC
account. You further agree to accept all responsibility for actions and
activities that occur using that account.
In
all cases, our ability to deliver all the functionality of the Services
requires a stable data connection and access to locational services like GPS.
If your phone’s ability to access data via wireless networks or the Internet is
compromised, the Services may be delivered incompletely, slowly, inaccurately,
or not at all. These connectivity problems can arise from many sources, ranging
from physical interference to power outages to errors by telecommunication
providers. Once again, your ability to effectively use the App or Services may
be compromised through no fault of SPTC, and we cannot accept any
responsibility for any problems or damages which might occur.
The
Services also depend on your device. If your device is damaged, not compatible
with the App (including updates to the App), or if you have turned off
permissions on which the App relies to deliver all the functionality of the
Services (such as location sharing), then your ability to effectively use the
App or Services may be compromised through no fault of SPTC, and we cannot
accept any responsibility for any problems or damages which might occur.
From
time to time we may need to make the App or the
Services unavailable in order to fix bugs, perform maintenance, install
updates, or similar tasks that improve the overall service we deliver. We make
every effort to do so during times that have the least impact, but we cannot
accept any responsibility for problems or damages that occur because of App or
Services unavailability for these reasons.
Finally,
our ability to effectively deliver the Services via the App depends on you
having access to the latest version of the App. If you delay or refuse updates
to the App, this may compromise or completely prevent us from delivering the
Services. We cannot accept any responsibility for any problems or damages which
might occur
3.
SPTC Transport
3.1.
Within the App, we offer certain features and enhanced functionality as paid
services. These are referred to as “SPTC Transport”. These services are
generally tied to a subscription, i.e. the regular purchase of the services
over a fixed period of time for a specific fee.
3.2.
The benefits included in SPTC Transport may change from time to time, as we
introduce new features, develop our existing offering and sometimes retire
features that aren't working out as planned.
3.3.
Like the Application itself, SPTC Transport is only available via the
third-party platform operators Apple App Store and Google Play Store.
Therefore, when you make a purchase within the Application, you additionally enter into a separate contract with the respective
third-party service provider, whose terms and conditions apply. Your right to
cancel your subscription must be exercised against these service providers (for
more details about contract duration and termination see 3.7).
3.4.
SPTC Transport is currently available for free download.
3.5.
To the maximum extent permitted by applicable laws, we may change our prices
for SPTC Transport at any time. We will give you reasonable notice of any such
pricing changes by posting the new prices on or through the mobile app and/or
by sending you an email notification. If you do not wish to pay the new prices,
you can cancel your subscription prior to the change going into effect. You
will be charged the revised price at the start of your next subscription period
(for instance, per month or per year) or on the renewal of your subscription.
3.6.
If payment cannot be collected, we will be entitled to block access to SPTC
Transport.
3.7.
If you no longer wish to subscribe, you are responsible for cancelling your
subscription in due time, regardless of whether or not
you actually use SPTC Transport features. Please note that your request to
cancel automatic renewal must be made using the same platform (the Apple App
Store or the Google Play Store) on which you originally subscribed (or started
a free trial) and that the terms and conditions of the Apple App Store and the
Google Play Store apply to such cancelation. Apple and Google generally require
a notice of termination or non-renewal to be provided no later than 24 hours
before the renewal of the subscription, but you should refer to Apple or Google
up to date policies and terms.
4.
Access to Services
a)
Limited Use Right
We
do not sell the App or any of the intellectual property contained in the App.
Instead, you are licenced to download a single copy
of the App onto each one of your devices.
Subject
to your compliance with these terms, and for as long as we make the Services
available through the App, you are hereby granted a limited, revocable,
non-exclusive, non-transferrable right to use the Services via the App. For
greater certainty, this does not include any right to directly access the
software, databases, algorithms or data which powers the Services and App, nor
any right to obtain a copy of the source code or architecture thereof.
Our
role is to make the App and Services available. As explained in the previous
section, we cannot control – nor accept any responsibility for – any other
issues.
Your
use right under these Terms is a personal, non-commercial right. It does not
extend to others, nor commercial activities, nor is it an enterprise-wide
right.
b)
Prohibited Uses and Activities
When
installing the App and using the Services, you must comply with all applicable
laws and regulations.
When
installing the App and using the Services, you must not: (i)
decompile, disassemble, reverse engineer, investigate, or otherwise access any
non-UI portion of the App; (ii) circumvent any limitations we place on your use
of the App or Services; (iii) use or display the App in such a way that allows
derivation of information about the Services that was not intended to be made
available to users; (iv) circumvent any security features or technological
protection measures built into the App; (v) automate access to the App or the
Services, including, without limitation, through the use of bots, scrapers or
other similar devices; (vi) attempt to install the App or access the Services
after having been banned by us.
5.
Disclaimer of Warranties
WE
HEREBY EXCLUDE ALL CONDITIONS AND WARRANTIES REGARDING THE APP AND THE
SERVICES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY CONDITION OR WARRANTY OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
NOTABLY,
AND WITHOUT LIMITING THE GENERALITY OF THE PRECEDING PARAGRAPH, WE DOES NOT
GUARANTEE ANY PARTICULAR LEVEL OF UP-TIME OR AVAILABILITY OF THE SERVICES. THE
SERVICES MAY BECOME UNAVAILABLE FOR MANY REASONS, INCLUDING SCHEDULED AND
UNSCHEDULED MAINTENANCE BY US.
6.
Limitation of Liability
WITH
THE EXCEPTION OF INTENTIONAL WRONGDOING OR GROSS NEGLIGENCE, WE SHALL NOT BE
LIABLE FOR ANY DAMAGES CAUSED BY OR RELATED TO THE APP, THE SERVICES, OUR
ACTIONS OR INACTIONS, OR THESE TERMS (INCLUDING THE BREACH OF THESE TERMS).
THIS LIMITATION OF LIABILITY SHALL APPLY TO ALL DAMAGES HOWEVER CAUSED, WHETHER
IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PROPERTY, PRIVACY, STATUTE, OR
OTHERWISE.
NOTABLY,
AND WITHOUT LIMITING THE GENERALITY OF THE PRECEDING PARAGRAPH, WE SHALL NOT BE
LIABLE FOR ANY LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS
OPPORTUNITIES, LOST TIME, OR LEGAL FEES AND LITIGATION EXPENSES.
b) Survival7. Termination and
Survival
a)
Termination without Cause
We
may terminate these Terms without cause and without prior notice if we choose
to discontinue the App, the Services, or both. You may terminate these Terms
without cause at any time by uninstalling the App and ceasing to use the
Services.
Clauses 1, 2, 4, 5, 6,
and 7 shall survive the termination of these Terms, and shall continue to bind both you and us.

General

You
may not assign any of your rights arising under these Terms without our written
consent.
d)
Status of the Parties
These
Terms do not create any relationship of employment, partnership, agency, trust,
franchise, or joint venture. Nor do they create any fiduciary duties.

Amendments
These
Terms can only be amended or suspended by following the procedure set out in
clause 1, above. No other amendment or suspension is valid, nor can any
purported waiver be set up against us unless the waiver follows the procedure
for an amendment set out in clause 1.
f) Entire
Agreement
These Terms (as amended from time to time) constitute the entire agreement between you and us regarding the App and the Services. These Terms (and any amendments) replace and supersede any previous or existing agreement, contract, understanding, or representation regarding the App or the Services.
g) Language
You and us have agreed that these Terms and all related documents be drawn up in the English language.
